Federal Order for Preservation of Explant for DePuy Pinnacle MDL

Plaintiffs who were included in the multidistrict litigation have received the latest case management order issued by United States District Judge Ed Kinkeade, leading newspapers say. Case management order No. 9 is a 27-page document that was issued last January 23, 2013 for the preservation of explants. After hip revision, plaintiffs are to take the necessary steps to preserve the integrity of the device especially the metal Ulatmet socket liner which often causes the problems among patients.

The explanted device is preserved because it may serve as evidence that may make or break the case. The surrounding tissues or any other physical evidence that may be related to the case may be kept as well. Plaintiffs are not required to have the prosthesis examined but may do so with their own discretion.
